1. Medtronic Warranty

Medtronic Diabetes warrants the products listed below against defects in materials and workmanship for the Warranty Periods specified. During the relevant Warranty Period, Medtronic Diabetes will, at its discretion, either repair or replace the relevant product, subject to the conditions and exclusions stated herein. In the case of pumps, Medtronic Diabetes reserves the right to replace the pump with a new or recertified pump, at its discretion. In the event that the product is repaired or replaced under this Medtronic Warranty, the Warranty Period will not be extended and will only continue to run from the date that the original Warranty Period commences as specified below.

This Medtronic Warranty is valid only if:

  1. The product is used in accordance with Medtronic’s instructions;
  2. Sterile packaging is not compromised while in the control of the user by any means other than purposeful opening by the user at the time of intended product use;
  3. Damage to which the warranty claim relates is not arising from:
    • Use of product by more than one end-user;
    • Opening of packaging on product other than in accordance with Medtronic’s instructions;
    • Use of non-Medtronic infusion sets and/or reservoirs with a Medtronic pump or Medtronic infusion sets and/or reservoirs with a non-Medtronic pump;
    • Service or repairs performed by any person or entity other than Medtronic;
    • An event or circumstance (force majeur) beyond the reasonable control of Medtronic including but not limited to flooding and other natural disaster;
    • Negligence or improper use, including but not limited to improper storage, submersion in water or physical abuse, such as dropping or otherwise.

This Product Warranty is personal to the original user. Any sale, rental or other transfer or use of products covered by this warranty to or by a person other than the original user shall cause the Medtronic Warranty to immediately terminate.

This Medtronic Warranty does not apply to batteries, glucose sensors and accessories.

3. Claiming under the Medtronic Warranty

Once Medtronic is notified of a defect in products covered by this Warranty, unless we agreed to replace the product without analysis, we will arrange for the device to be collected from your premises at our expense and returned to our headquarters to be analysed and to determine what action will be taken. Any products repaired or replaced under the Medtronic Warranty will be delivered again to your premises, at our expense. Medtronic will also reimburse any other reasonable expenses you incur in making your claim under the Medtronic Warranty.

4. Exclusions and Limitations in the Medtronic Warranty

The Medtronic Warranty applies to new devices sold and not to any used devices or replacement devices supplied under warranty or provided on loan, although you may have some consumer rights in respect of such products.

The remedies provided for in the Medtronic Warranty are the exclusive remedies available for any breach hereof. Neither Medtronic Diabetes nor its suppliers or distributors shall be liable for any incidental, consequential, or special damage of any nature or kind caused by or arising out of a defect in the product. Notwithstanding the foregoing, the terms of this warranty do not affect the statutory rights of consumers or seek to exclude any liability which is not permitted by law. All other warranties, other than mandatory statutory warranties, expressed or implied, are excluded, including the warranties of merchantability and fitness for a particular purpose.

5. Your Consumer Rights

Medtronic Diabetes products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure ("Your Consumer Rights").

The benefits granted in the above Medtronic Warranty are additional to, and do not detract from, any rights and remedies that you may have under Australian laws, including the Australian Consumer Law. Any exclusions of direct, incidental, consequential or other damages and other warranties (including express or implied warranties of merchantability, fitness for a particular purpose, etc), referred to in the Medtronic Warranty apply only to your rights under that warranty and do not affect Your Consumer Rights.
